ACCEPTANCE OF TERMS OF USE
These TERMS OF USE govern your use of the Long Island Firewood web site and your online purchase agreement. By using, visiting, placing online orders or browsing this web site, you accept and agree to be bound by these TERMS OF USE. These TERMS OF USE affect your legal rights and you should read them carefully.

PAYMENTS
Long Island Firewood orders are prepaid via credit card or digital currency only. Long Island Firewood does not accept cash or check payments.

DELIVERIES
Long Island Firewood delivery dates and times are subject to change without notice.
Long Island Firewood is not responsible for exact delivery dates or times.

Long Island Firewood reserves the right to make partial deliveries and/or substitutions.

Long Island Firewood delivery fees at the checkout time, an order can be cancelled at that time. Long Island Firewood reserves the right to add additional delivery charges, cancel deliveries, reschedule delivery dates & times due to, but not solely limited to inclement weather, misleading customer information, dangerous driver conditions, traffic conditions, or other unforeseen hazards or liabilities. The independent drivers contracted by Long Island Firewood provide a service to both Long Island Firewood and the customer. All deliveries and associated liabilities are the sole responsibility of subcontracted trucking company & each individual driver and by agreeing to the aforementioned you release Long Island Firewood from any liability, compensation, prosecution, or litigation arising from delivery of Long Island Firewood products.

In the event a delivery truck arrives on site and is unable to complete your firewood delivery due to limited site access, unsafe conditions, or other circumstances beyond driver control, you will be responsible to reschedule the delivery and incur an additional duplicate delivery charge + restocking fee for the return of your firewood to the trucking companies yard.

STACKING SERVICES
DRIVERS DO NOT REMOVE FIREWOOD FROM THE BAGS

Long Island Firewood may provide optional stacking services for your firewood delivery. STACKING SERVICES INCLUDE THE MOVEMENT & STACKING OF THE BAGS ONLY. WE DO NOT REMOVE FIREWOOD FROM THE BAGS. ALL STACKING SERVICES ARE AT THE SOLE DISCRETION OF Long Island Firewood AND THE INDEPENDENT DELIVERY DRIVERS CONTRACTED BY Long Island Firewood. Long Island Firewood reserves the right to levy additional stacking fees, reschedule stacking and/or refuse stacking of any delivery. Stacking services may be suspended at any time due to high volume or poor weather conditions. Long Island Firewood IS RESPONSIBLE ONLY FOR THE DELIVERY OF FIREWOOD TO YOUR INVOICED DELIVERY ADDRESS WHERE THERE IS SAFE ACCESS FOR OUR TRUCKS. ADDITIONAL MOVEMENT OF FIREWOOD IS OPTIONAL. STACKINGS CANNOT BE PERFORMED IF THERE IS NO ONE HOME DURING THE TIME OF THE DELIVERY.

GUARANTEE TERMS
All claims for returns must be made in writing (e-mail) within 14 days of delivery.
Firewood appearance or other non-burning characteristics are not guaranteed.
The guarantee is specific to firewood moisture content only.
*Dry firewood is less than 30% moisture content on average as per a calibrated moisture meter.
The Kiln Dried firewood must remain in its original packaging.
The return must be accompanied by the original Batch Tag(s).
All firewood must be stored indoors or adequately covered outdoors. Exposure to moisture voids guarantee.
Guarantee does not apply to discounted items, Northern Cut KD, or non-Kiln Dried products.
All refunds will be made within 7 days of return restocking.
Refunds will be made for the full product purchase price and do not include delivery charges.
Delivery fees are non-refundable.
Pick-up dates of returned firewood are at the sole discretion of Long Island Firewood.
Any exchanges will be made within 7 days of return.
An LIF Claims Representative must visit your home to determine the validity of the return.
One return per household.
This guarantee is at the sole discretion of Long Island Firewood and only those aforementioned terms will be honored.

ORDER CANCELLATIONS, EXCHANGES, REFUNDS & DIGITAL PAYMENTS

Long Island Firewood guarantees our Kiln Dried firewood to be dry as per the conditions of our Guarantee Terms outlined above. Long Island Firewood does not guarantee delivery dates & times, specific firewood packaging or specific delivery placement. We are not responsible for orders delivered when the customer is not home to accept delivery. All claims must be made to the driver during the delivery. Later claims will not be honored (other than our 100% Guaranteed Dry guarantee).

Your online purchase is a binding legal contract. Long Island Firewood is obligated to insure the delivery of the purchased products as shown on your check out receipt. Any substitutions, additions, deletions or other changes in your order may incur additional charges. A MINIMUM 10% RESTOCKING CHARGE WILL BE CHARGED FOR ANY REFUSED OR UNDELIVERED ITEMS. Returned items must be fully intact in the original packaging and be accompanied by the certification tag. Long Island Firewood will not issue a full refund for any item returned after 14 days.

Long Island Firewood charges a minimum of 10% for any canceled orders to cover accounting fees, merchant fees and other associated costs incurred. All refunds will be made back to the credit card used for purchase. All credit card chargebacks made at customer request will result in full liability of total balance of charges. Customers may not chargeback and receive full refund at the expense of Long Island Firewood. Customers will be responsible for additional delivery fees, exchange fees, restocking fees, portions of orders not returned, additional labor and all accounting fees resulting from chargeback.

Digital payments are made at sole discretion & liability of the customer. Digital payments are made directly from the customer to Long Island Firewood (peer 2 peer). There is no middle processing agent. Long Island Firewood is not liable for digital payments made to incorrect wallet addresses. Long Island Firewood is not responsible for errors in payment amount, exchange rates, network congestion, network failure or other digital failures. Refunds requested on orders paid digitally will only be refunded in the same digital currency at the exchange rate of the time of the purchase, or time of the requested refund, whichever is less. Digital payment options may be suspended at any time. Digital payments may be refunded any time before order delivery & the order requested paid via credit card or cancelled.

PRIVACY AND PERSONAL INFORMATION
Long Island Firewood is committed to protecting the privacy of the personal information you provide us on our Web site. Any information submitted on the Long Island Firewood Web site is submitted over our secure encrypted 256-Bit connection. Your personal and financial information is never shared with anyone and is used solely for Long Island Firewood transactions.

Any delivery photos taken by Long Island Firewood are the sole possession of Long Island Firewood. By agreeing to our Terms of Service Long Island Firewood has your permission to use the photos on this web site.

WEBSITE ACCESS
Long Island Firewood hereby grants permission to use the Website as set forth in this Terms of Service, provided that: (i) your use of the Website as permitted is solely for your personal, noncommercial use; (ii) you will not copy or distribute any part of the Website in any medium without Long Island Firewood’s prior written authorization; (iii) you will not alter or modify any part of the Website other than as may be reasonably necessary to use the Website for its intended purpose; and (iv) you will otherwise comply with the terms and conditions of these Terms of Service.

GENERAL
You agree that: (i) the Long Island Firewood Website shall be deemed solely based in New York; and (ii) the Long Island Firewood Website shall be deemed a passive website that does not give rise to personal jurisdiction over Long Island Firewood, either specific or general, in jurisdictions other than New York. These Terms of Service shall be governed by the internal substantive laws of the State of New York, without respect to its conflict of laws principles. Any claim or dispute between you and Long Island Firewood that arises in whole or in part from the Long Island Firewood Website shall be decided exclusively by a court of competent jurisdiction located in Suffolk County, New York. YOU AND Long Island Firewood AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE Long Island Firewood WEBSITE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES.
